Plaintiff Produced No Evidence That Political Affiliation Was Motivating Factor In Failure To Hire
Randy George sued a number of State employees under 42 U.S.C. § 1983, alleging that they violated his First Amendment rights when they failed to offer him the position of Business Administrator at the Tamms Correctional Center because of his affiliation with the Republican party. The district court granted summary judgment in favor of all of the defendants because George failed to produce any evidence that his political affiliation was a motivating factor in the decision not to hire him. On appeal, the 7th Circuit affirmed.
