School District's Lack Of Liability For Alleged Molestation By Former Employee--Certiorari Denied

The United States Supreme Court has refused to grant certiorari in a case in which the Eleventh Circuit Court of Appeals held that a school district was not liable under 42 U.S.C.A. § 1983 to parents for a teacher's alleged molestation of their minor daughters. The teacher had formally been employed by the school district, but was employed by a different school district at the time of the alleged conduct. Thus, the 11th Circuit reasoned, the school district had no authority to control the teacher so as to be liable under § 1983.
