
Proffered Explanation For Teacher’s Reassignment Was Not Pretext For Age Discrimination
Affirming the trial court’s grant of summary judgment to the defendant, the 2nd Circuit has held that a school district's proffered explanation for the reassignment of a schoolteacher from teaching second grade in a classroom to teaching academic intervention services in a hallway, specifically concerns about her teaching that coalesced in the school year before she was reassigned, was not a pretext for discrimination violating the Age Discrimination in Employment Act (ADEA). No school official ever made any comments to her about her age. Further, there was no indication that older teachers within the school district were in any way treated differently than younger ones.
