More FMLA Changes Are On The Way

Congress recently enacted amendments to the Family and Medical Leave Act providing for leave in certain military situations. To see our Client Bulletin (1/30/08) on those amendments, click here.

Now, the U.S. Department of Labor has announced that today it will be publishing proposed FMLA regulations. These regulations were promised years ago but had not been issued. Among other things, the proposed regulations are reported to deal with the definition of "serious health condition," fitness for duty examinations, recertifications, and other key provisions.

The DOL will also be seeking comment on various provisions of the new military amendments to the FMLA.

Constangy will keep you updated on all of these developments. Once the dust settles, we will also revise our model FMLA policy and get that to you for use in revising your own policies.
