Plaintiff Failed To Establish Prima Facie Case Of Sexual Discrimination Or Retaliation

Jeri L. Gates brought suit alleging that Caterpillar, Inc. engaged in unlawful sexual discrimination and retaliation in violation of Title VII. The district court granted Caterpillar's motion for summary judgment. On appeal, the 7th Circuit affirmed, holding that: 1) Gates did not produce evidence that any protected conduct was a substantial or motivating factor in Caterpillar’s decision to terminate her employment; 2) Gates could not show that her job performance was satisfactory; and 3) Gates failed to make a prima facie case of gender discrimination
