Claim Of Wrongful Transfer Survived Summary Judgment

In this case, a suit by a medical technologist against the Veterans' Administration, claiming that she was forced to transfer to another hospital, adding two hours to her commute, survived summary judgment. The court found fact issues as to whether her transfer was gender discrimination, in violation of Title VII, as she was moved out of the hospital following an altercation with a male employee, and he was allowed to remain. There were also fact issues as to whether the hospital violated her due process rights, by transferring her and reducing her work responsibilities without following its prescribed procedures.
