
Employer Provided Unrebutted Legitimate, Non-Retaliatory Reasons For Demotion And Transfer
Hughes sued the employer for retaliation in violation of his First Amendment free speech rights alleging demotion and transfer. The trial court granted the employer's motion for summary judgment. The 8th Circuit affirmed. The court found that the legitimate, non-retaliatory reasons offered by the employer (four complaints which were not initiated or undertaken in retaliation) were not overcome by the evidence produced by Hughes (nothing in the record supported Hughes's contrary claims or conspiracy theory).
