
Employee Stated Prima Facie Title VII Retaliation Claim
In this case, the United States District Court
held that an African-American plaintiff stated a prima facie Title VII
retaliation claim. The employee's "threat" to obtain legal counsel in order to
sue the employer for race discrimination was protected conduct, and a Caucasian
supervisor's reference to the employee's protected conduct in the same document
in which he recommended that the employee be demoted satisfied the causal link
element.
