
Plaintiff In ADA Retaliation Suit Failed To Show Causal Connection Or Pretext
A former employee brought this action alleging that his employer, UPS, terminated him in retaliation for filing administrative charges of disability discrimination, in violation of the Americans with Disabilities Act (ADA). The United States District Court entered summary judgment in favor of UPS, and the employee appealed. The 10th Circuit affirmed the grant of summary judgment for UPS, holding that the employee failed to show that a causal connection existed between his filing of administrative charges and his discharge, and he failed to show that the reasons UPS gave for his discharge were pretext.
